These conditions of sale have as their object the purchase of products and services made by fax, telephone, e-mail and through the Techly.com website managed by IC Intracom Italia S.p.A. with registered office in Sacile, Viale Europa 33, Loc. Cornadella - 33077 Pordenone, registered in the Business Register of Pordenone REA number PN 47752 - and VAT number 01191370939
Acceptance of the general conditions of sale
1. The contract stipulated between IC Intracom Italia S.p.A. and the Customer must be considered concluded with the acceptance, even if only partial, of the order by IC Intracom Italia S.p.A. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
2. To make a purchase on the Site, the Customer must be of age. By accepting the conditions of sale, the Customer declares and guarantees that he is of age, that he will provide true and correct data and that he has full legal capacity to enter into binding agreements.
3. If the Customer is a consumer, once the online purchase procedure has been completed, he will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance selling.
4. Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to people and/or things, caused by the non-acceptance, even partial, of an order.
Methods of purchase
4.The Customer can only purchase the products present in the electronic catalog of Techly.com at the time of placing the order and viewable online at (URL) www.Techly.com, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be perfectly representative of its features but differ in color, size, accessory products in the pictures. All purchase support information is intended as a simple generic information material, not referable to the real features of a single product.
5.Correct receipt of the order is confirmed by IC Intracom Italia S.p.A. by an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain the date and time of execution of the order and a 'Customer Order Number', to be used in any further communication with Techly.com. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
6.In case of non-acceptance of the order, IC Intracom Italia S.p.A. guarantees timely communication to the Customer.
Terms of payment
7.Credit cardIn cases of purchase of goods with credit card payment methods, at the same time as the online transaction is concluded, the reference bank will authorize only the commitment of the amount relating to the purchase made.
7.1In case of cancellation of the order, both by the Customer and in case of non-acceptance of the order by IC Intracom Italia S.p.A., it will be requested by IC Intracom Italia S.p.A. the cancellation of the transaction and release of the committed amount. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry date (24th day from the date of authorization). Once the transaction has been cancelled, in no case IC Intracom Italia S.p.A. can be held responsible for any damage, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.
7.2IC Intracom Italia S.p.A. reserves the right to charge the customer's credit card in order to avoid the expiry of the authorization of the transaction which occurs on the 23rd day.
7.3IC Intracom Italia S.p.A. has the right to request additional information from the customer (eg landline phone number) or to send copies of documents proving ownership of the card used. In the absence of the required documentation, IC Intracom Italia S.p.A. reserves the right not to accept the order.
7.4 At no time during the purchase procedure IC Intracom Italia S.p.A. is able to know the information relating to the buyer's credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction. No computer archive of IC Intracom Italia S.p.A. will keep such data. 7.5Credit cards accepted are all those that rely on the circuits indicated on the site.
8.Cash on deliveryIn case of purchase on delivery, a fixed supplement of € 3.00 + VAT will be applied to the total amount. Payment must be made exclusively in the manner indicated by IC Intracom Italia S.p.A. when ordering. The communication to the Customer of which courier will be in charge of the delivery will be carried out in the manner provided on the site. Nothing more than what is indicated at the time of the order will be due by the Customer.
8.1The balance to the courier can be made through:
Cash on delivery (up to 999 euros): make the payment to the courier upon delivery of the purchased product. The courier accepts only exact amounts; the change is not expected to be returned.
Cash on delivery with cashier's check:make the payment to the courier upon delivery of the purchased product. The courier accepts onlycashier's checks made out to IC Intracom Italia S.p.A.; the acceptance of bank checks is not envisaged.
8.2IC Intracom Italia S.p.A. in the case of the customer's first order, will make correspondence and truthfulness of the data entered in the order through a telephone call from its employees. For amounts exceeding 500.00 euros, a 20% deposit can be requested with payments or by credit card or by bank transfer according to methods that will be communicated by IC Intracom Italia S.p.A.
9. Advance Bank Transfer/Postal Transfer:in case of payment by Advance Bank Transfer, IC Intracom Italia Spa undertakes to keep the product of your interest secluded at a fixed price for a few days, the time normally necessary for the conclusion of the currency transfer practices.

The order will be sent only when the amount due is actually credited to the current account of IC Intracom Italia S.p.A. which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be considered automatically cancelled. The purpose of the bank transfer must include:
· The order reference number;
· The date the order was placed;
· Name and surname of the order holder.
10.Purchases viaPayPal In the case of purchase of goods with PayPal payment method, at the same time as the conclusion of the online transaction, PayPal will immediately charge the amount relating to the purchase made.
10.1 In case of cancellation of the order, both by the Customer and in the case of non-acceptance of the same by IC Intracom Italia S.p.A., together with the cancellation, the amount relating to the cancelled goods will be re-credited to the customer's PayPal account. The timing of re-credit on the payment instrument chosen within the PayPal account depends exclusively on PayPal and the banking system. Once the amount has been credited back to the PayPal account, in no case IC Intracom Italia S.p.A. can be held responsible for any damages, direct or indirect, caused by delays in the actual re-credit by PayPal or by the banking system.
10.2 Intracom Italia S.p.A. reserves the right to request additional information from the Customer (eg landline telephone number) to determine the actual ownership of the PayPal account. In the absence of the required documentation, IC Intracom Italia S.p.A. reserves the right not to accept the order.
10.3 At no time during the purchase procedure IC Intracom Italia S.p.A. is able to know the information relating to the buyer's credit card or the financial information of the PayPal account. In no case IC Intracom Italia S.p.A. can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment for products purchased on Techly.com.Back to index »
Delivery methods and costs
11.Techly.com can only accept orders with delivery in the EU territory, orders with delivery in other countries can be managed by prior agreement. In this case the shipping costs will be calculated and communicated to the customer after the order and the payment method will be an advance bank transfer. The cancellation of the order is possible up to the moment of the order fulfillment which takes place with the issue of the transport document or invoice.
12.For each order placed on Techly.com, IC Intracom Italia S.p.A. issues an invoice for the material sent, sending it by e-mail to the holder of the order, pursuant to Article 14 of the D.P.R. 445/2000. For the issuance of the invoice will be used the information provided by the Customer at the time of the order. No change in the invoice will be possible after its issue.
13.Delivery costs and/or any additional costs are charged to the Customer. The payment of the goods by the Customer will take place using the method chosen at the time of the order. Nothing more is due by the Customer with respect to the total order shown at the end of the purchase procedure.
13.1Shipping costs are calculated based on the weight of the goods according to the following table:

14.No responsibility can be attributed to IC Intracom Italia S.p.A. in case of delay in the order or delivery of the order.
15.The delivery of what is ordered means at street level unless otherwise communicated by our customer service. Upon delivery of the goods by the courier, the Customer is required to check:
that the number of packages delivered corresponds to what is indicated on the invoice;
that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps)
Any damage to the packaging and/or the product or the mismatch in the number of packages or indications, must be immediately contested, affixing WRITTEN CONTROL RESERVE (SPECIFYING THE REASON FOR THE RESERVE, eg "punctured packaging", "crushed packaging", etc.) on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 5 days of delivery by fax or registered letter with return receipt.
16.In case of non-collection within 5 working days of the material present in storage at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be returned to the IC Intracom Italia S.p.A. warehouses.
17.Once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered. Right of withdrawal
18.Pursuant to art. 64 et seq. of Legislative Decree no. 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to Techly.com), has the right to withdraw from the purchase contract for any reason within 30 days of receipt of the goods, without any penalty and without prejudice to what is indicated in point 3 below.
19.To exercise this right, the customer must enter a withdrawal request in which it will also be necessary to indicate the bank details necessary to return the sums paid; the system will send the customer by e-mail a paper form which must be printed and sent by registered letter with acknowledgment of receipt within 14 days from the date of receipt of the goods to: Techly.com C/O IC Intracom Italia S.p.A. based in Sacile 33077 (PN) viale Europa, 33 - Z.I. Cornadella SUD. Upon receipt of the registered letter, Techly.com will send the customer the form for exercising the right of withdrawal via e-mail with an authorization number which must be attached to the outside of the envelope in which the product will be physically placed and sent to Techly.com within 14 days from authorization.
20.The right of withdrawal is however subject to the following conditions:
the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, attached software, etc ...);
the law does not apply to audiovisual products or sealed computer software (including those attached to hardware material), once opened;
the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend placing it in a second box, on which to affix the label provided by IC Intracom Italia S.p.A., with the RMA number (return authorization code); in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided;
the good subject to the exercise of the right of withdrawal must have the same serial number (IF IT EXISTS) on the Techly.com sales invoice; if the goods have a serial number different from what is indicated on the invoice, the return will not be accepted and the product will be made available to the customer for its return, at the same time cancelling the request for withdrawal;
the shipping costs for returning the goods are charged to the customer;
the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
in case of damage to the goods during transport, Techly.com will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain the reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, at the same time cancelling the request for withdrawal;
Techly.com is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;;
ATTENTION: Techly.com staff is not authorized to collect goods whose packaging does not bear the RMA number.
Upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and/or the original packaging are damaged, IC Intracom Italia S.p.A. will deduct from the reimbursement due a percentage, in any case not exceeding 10% of the same, as a contribution to the restoration costs.
21.Without prejudice to any repair costs for damage to the original packaging, IC Intracom Italia S.p.A. will refund the customer the amount already paid for the purchase of the goods, within 14 days of his return, by means of a reversal of the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the reimbursement (IBAN code and Bank of the invoice holder).
22.The right of withdrawal is totally lost, for lack of the essential condition of integrity of the asset (packaging and/or its contents), in cases where IC Intracom Italia S.p.A. make sure:
· The lack of the external packaging and/or the original internal packaging;
· The absence of integral elements of the product (accessories, cables, manuals, parts, ...);
· Damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, the goods will remain at the headquarters of IC Intracom Italia S.p.A., available to the Customer for collection at his expense.
23.The credit in favour of the customer can be partial in the event that the goods have suffered a decrease in value, such as:
· Not diligent use of the product
· Even partial use of the goods and any consumables
· Damaged packaging or in any case not intact as received
24.All products sold by Techly.com are covered by the manufacturer's conventional warranty and by the 24-month warranty for lack of conformity, pursuant to Legislative Decree 206/05. To use the warranty, the Customer must keep the invoice (or DDT) that he will receive via e-mail in PDF electronic format. The application of the Warranty may require for assistance to the authorized assistance centers present in the area and/or follow the procedures illustrated in the documentation inside the product packaging.
25.The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transport costs, if supported by IC Intracom Italia S.p.A.
26. The 24-month warranty pursuant to Legislative Decree 206/05 applies to products that present a lack of conformity, provided that the product is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). In case of lack of conformity, IC Intracom Italia S.p.A. provides, at no cost to the Customer, to restore the conformity of the product by repairing/replacing or reducing the price, until the contract is terminated. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 206/05, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs if incurred by IC Intracom Italia S.p.A.
27.The replacements in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.
28. In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, IC Intracom Italia S.p.A. may proceed at its own discretion to refund the amount paid taking into account the use of the goods or to replace it with a product of equal or superior characteristics.
29.The repair or replacement times of the product depend exclusively on the manufacturer's policies and no damage can be requested from IC Intracom Italia S.p.A. for any delays in carrying out repairs or replacements.
30. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ..); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original product packaging should be avoided.
The Customer will be provided with an authorization number for the return of the product (RMA) which must be indicated on the outside of the packaging, following the instructions provided directly in the relative authorization e-mail.

32.The sales contract between the Customer and IC Intracom Italia S.p.A. it is understood to be concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Pordenone.Back to index »
